Assault and battery cases can vary, depending on the severity of the situation. They include:
Assault
Assault is the intentional, unlawful threat by word or act of violence from one person to another. The victim must feel that the action could be made, and the defendant must also act in a way that leads them to believe this. Assault can either be a misdemeanor or felony, depending on your unique situation.
Aggravated Assault
Aggravated assault is very similar to “simple” assault, in that threats or acts of violence are made. However, if a deadly weapon w a third-degree felony that can carry long consequences if the defendant is as used in the course of action, without the threat to kill, then it is considered aggravated. This is a more serious crime, as it is consideredconvicted.
Battery
Battery is different from assault, as it is defined as someone intentionally and actually touching or hitting another person. This action must be unwanted and can result in bodily harm to the victim.
Aggravated Battery
Aggravated battery is the more serious form of battery, as it must cause great bodily harm or permanent disability to the victim. This is also the standard for a crime committed for battery while using a deadly weapon.
