On September 23, 2019, national attention fixed on Texas for the trial of Amber Guyger, the Dallas police officer accused of the murder of civilian Botham Jean in what’s being called the “mistaken apartment murder.”

That evening, our own Heather Barbieri appeared on CourtTV to discuss how proceedings went on the first day of the trial for the station’s “Who Had a Better Day” segment.

Barbieri Law Firm’s Heather Barbieri, a Board-Certified Criminal Defense Specialist, felt the prosecution came out on top with a strong and emotional presentation of the victim, Botham Jean, eating a bowl of ice cream in his own apartment. She mentioned the accurate depiction of the shock he must have felt upon Guyger’s unexpected entrance. The prosecution’s detailed description of the apartment made it easy for the jury to picture themselves in the scenario and feel empathy for the victim, said Barbieri.

However, the panel of four criminal defense attorneys was split in their opinion of the outcome of day one proceedings.

Teri Thompson agreed with Heather Barbieri that the prosecution led the day with their vivid and convincing opening statement. Darryl Cohen and Katie Armstrong disagreed with Thompson and Barbieri, saying the defense’s opening statement was logical and well-reasoned, and an accurate portrayal of Guyger’s state of mind helped humanize the defendant.

The trial continues this week at the Dallas County Courthouse.
