The legal age of consent in the state of Texas is 17 years of age. Texas law defines a child victim in sex crimes as a person under 17 years of age, or a person who the accused believes to be under 17 years of age. Sometimes the term “minor” is used instead of “child.”

  • Improper student-teacher relationship. Sexual contact with a student by an employee of a private or public school where the student is enrolled, or employee of the school district they are in. The employee may also be charged with the sexual assault of a child.
  • Sexual assault and aggravated sexual assault of a child. A child’s age determines the difference between sexual assault of a child and aggravated sexual assault of a child. Sexual assault of a child involves the sexual penetration of a person 14-16 years of age. This is often referred to as “statutory rape.” Aggravated sexual assault of a child is the sexual penetration of a child under 14 years of age.
  • Continuous sexual abuse of a child. Two or more acts of sexual abuse committed over a period of 30 days or more, by a person 17 years of age or older and against a child younger than 14 years of age.
  • Indecency with a child. The exposure of private parts of the body to a child, or causing a child to expose themself, for the purpose of sexual gratification.
