How is Promotion of Child Pornography defined in the state of Texas?
Section 42.26 of the Texas Penal Code outlines the law against promoting child pornography as an offense committed if a person knowingly or intentionally “promotes or possesses with intent to promote” videos, photos, or other materials (both physical and electronic) of a child under the age of 18 who is “engaging in sexual conduct.”
Despite the complexity of the phrase “intent to promote,” Section 43.25 assigns the meaning of “promote” by stating that it is illegal for a person to “procure, manufacture, issue, sell, give, provide, lend, mail, deliver, transfer, transmit, publish, distribute, circulate, disseminate, present, exhibit, or advertise or to offer or agree to do any of the above.”
If convicted of promoting child pornography, a person may face the following punishments:
- First offense: Second-degree felony, which can result in 2-20 years in prison and fines up to $10,000.
- Second or subsequent offense: First-degree felony, punishable by 5-99 years in prison and fines up to $10,000.
